This Privacy Policy explains how Oyster collects, uses, stores, protects, and shares information when users access or use our website, software, applications, dashboards, ordering tools, POS tools, inventory tools, reservation tools, payment-related features, and related services.
By creating an account, accessing Oyster, or using any Oyster service, you agree to the practices described in this Privacy Policy.

1. Information We Collect
When you use Oyster, we may collect the following types of information:
Account Information
This may include your name, business name, email address, phone number, username, password, role, billing details, and other information provided during registration.
Business and Restaurant Information
This may include menus, prices, products, categories, inventory data, staff records, table layouts, reservations, customer orders, sales data, reports, and business preferences.
Customer and Transaction Information
Where applicable, Oyster may process customer names, contact details, order details, delivery or pickup information, payment status, table numbers, reservation details, and similar information entered into the platform.
Technical Information
We may collect IP addresses, device type, browser type, operating system, login activity, usage data, error logs, access times, and other technical data used to operate, secure, and improve Oyster.
Payment Information
Oyster may connect with third-party payment processors. We do not intentionally store full card numbers unless expressly stated. Payment processing is generally handled by third-party providers subject to their own terms and privacy policies.

2. How We Use Information
We use information to:
  •  create and manage user accounts; 
  •  provide access to Oyster services; 
  •  process orders, reservations, payments, reports, inventory, and restaurant operations; 
  •  provide customer support;

  •  communicate service updates, technical notices, and administrative messages;

Note:  By registering for Oyster, users consent to the storage and processing of their information on servers located in the United States. 

3. User Responsibility for Data
Users are responsible for ensuring that any information entered into Oyster is accurate, lawful, authorized, and properly collected.
Users are responsible for obtaining any required permissions or consents from their own customers, employees, contractors, suppliers, or other individuals whose information is entered into Oyster.
Users are also responsible for maintaining appropriate backups of their own business records, including sales reports, customer information, menus, pricing, inventory, and transaction-related data.
Oyster is not intended to be the sole storage location for critical business data.

4. Data Security
We take reasonable technical, administrative, and organizational measures designed to protect information against unauthorized access, loss, misuse, alteration, or destruction.
However, no software platform, internet transmission, server, network, database, or storage system can be guaranteed to be completely secure.
By using Oyster, you acknowledge and accept that cyber-attacks, unauthorized access, malware, ransomware, hosting failures, data corruption, service interruptions, third-party failures, human error, hardware damage, and other security incidents may occur despite reasonable precautions.

5. Cyber-Attacks, Data Loss, and Service Disruption
To the maximum extent permitted by law, Oyster, its owners, directors, employees, contractors, developers, service providers, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or business-related losses arising from:
  •  cyber-attacks; 
  •  hacking; 
  •  unauthorized access; 
  •  data breaches; 
  •  data loss; 
  •  corrupted data; 
  •  server failure; 
  •  hosting provider failure; 
  •  payment provider failure; 
  •  internet outages; 
  •  malware or ransomware; 
  •  system downtime; 
  •  loss of profits; 
  •  loss of revenue; 
  •  loss of customers; 
  •  business interruption; 
  •  loss of goodwill; 
  •  loss of reputation; 
  •  damaged hardware; 
  •  damaged software; 
  •  third-party service failures; 
  •  user error; 
  •  employee misuse; 
  •  weak passwords; 
  •  unauthorized account sharing. 
Users agree that Oyster is provided on an “as is” and “as available” basis, and that use of the platform is at the user’s own risk.

6. No Guarantee of Continuous Availability
We aim to keep Oyster available and functional, but we do not guarantee uninterrupted, error-free, or fully secure service.
Oyster may be unavailable from time to time due to maintenance, updates, outages, cyber incidents, technical problems, infrastructure issues, third-party provider failures, or events outside our control.
We are not responsible for losses resulting from temporary or permanent unavailability of the platform.

7. Third-Party Services
Oyster may integrate with third-party services, including but not limited to payment processors, hosting providers, email providers, analytics tools, delivery services, messaging services, and other software providers.
We are not responsible for the privacy practices, performance, security, outages, errors, data handling, or actions of third-party providers.
Use of third-party services may be subject to separate terms, policies, charges, and limitations.

8. Data Storage, Hosting, and International Transfers
Oyster’s servers and hosting infrastructure are located in the United States of America and may be operated by third-party hosting, cloud, security, database, backup, monitoring, or infrastructure providers.
By creating an account or using Oyster, you acknowledge and agree that any information entered into the platform may be collected, processed, stored, transferred, accessed, backed up, or maintained in the United States or in other jurisdictions where Oyster or its service providers operate.
Where required by applicable law, Oyster will take reasonable steps to ensure that personal data transferred outside of the user’s country is handled with appropriate safeguards. However, users acknowledge that data protection laws in the United States or other jurisdictions may differ from those in their own country.
Users remain responsible for ensuring that they have the legal right to upload, process, transfer, and store any personal data, customer data, employee data, business records, or transaction information entered into Oyster, including where such data is transferred internationally.
To the maximum extent permitted by law, Oyster shall not be liable for any loss, claim, damage, regulatory penalty, business interruption, or dispute arising from the international storage, transfer, hosting, backup, or processing of data, except where liability cannot legally be excluded.

9. Data Retention
We retain information for as long as necessary to provide our services, maintain business records, comply with legal obligations, resolve disputes, enforce agreements, and support legitimate business purposes.
Users may request deletion of certain account data, subject to legal, technical, contractual, backup, fraud-prevention, accounting, tax, or operational requirements.
Deleted information may remain in backups, logs, archives, or disaster recovery systems for a limited period.

10. User Account Security
Users are responsible for keeping login credentials confidential.
Users must not share passwords, allow unauthorized access, or use weak or reused passwords.
Oyster is not responsible for losses caused by compromised credentials, unauthorized users, shared accounts, employee misuse, poor internal controls, or failure to secure user devices.
Users must notify Oyster immediately if they suspect unauthorized access to their account.

11. Access, Correction, and Deletion Requests
Depending on applicable law, individuals may have rights to access, correct, update, restrict, object to, or request deletion of certain personal information.

Where Oyster is used by restaurants, cafés, food businesses, or other commercial users, the business user remains responsible for the data they collect from their own customers, staff, suppliers, or guests.
Oyster may process such data only for the purpose of providing the platform and related services, unless otherwise permitted by law or agreement.
Business users are responsible for complying with all privacy, employment, consumer protection, payment, tax, and data protection obligations applicable to their own operations.

13. Children’s Data
Oyster is intended for business use and is not directed toward children.
Users must not knowingly enter children’s personal information into Oyster unless they have a lawful basis and all necessary permissions to do so.

14. Legal Compliance
We may disclose information where required to comply with applicable law, legal process, court orders, regulatory requests, tax obligations, fraud prevention, security investigations, or enforcement of our agreements.

15. Limitation of Liability
To the maximum extent permitted by applicable law, Oyster’s total liability for any claim relating to privacy, data, security, platform access, service interruption, or data loss shall be limited to the amount paid by the user to Oyster for the service during the three months immediately preceding the event giving rise to the claim, or USD $100, whichever is greater.
Nothing in this Privacy Policy excludes liability where such exclusion is not permitted by law.

16. Indemnity
Users agree to indemnify and hold harmless Oyster, its owners, directors, employees, contractors, developers, affiliates, and service providers from any claims, damages, losses, penalties, expenses, legal costs, or liabilities arising from:
  •  misuse of the platform; 
  •  unlawful data entered by the user; 
  •  failure to obtain required consent; 
  •  violation of privacy laws; 
  •  employee or customer claims; 
  •  unauthorized account access caused by the user; 
  •  breach of this Privacy Policy; 
  •  breach of Oyster’s Terms of Service; 
  •  use of third-party services. 

17. Changes to This Privacy Policy
We may update this Privacy Policy from time to time.
When changes are made, we may notify users by email, dashboard notice, website update, or other reasonable method.
Continued use of Oyster after updates means the user accepts the revised Privacy Policy.

18. Privacy Policy Acceptance
 By creating an account, I confirm that I have read, understood, and agree to Oyster’s Privacy Policy and Terms of Service. I understand that Oyster’s servers may be hosted in the United States, that my data may be stored or processed outside my country, and that I am responsible for maintaining my own backups and securing my account credentials.
